Terms of service

These Terms govern your use of GirlAndStories (the “Service”). By checking the acceptance box, placing an order or using the Service, you agree to these Terms and our Privacy policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You may use the Service only in compliance with laws that apply to you.

2. The service and AI-generated results

GirlAndStories creates digital portraits from a photograph and styles you select. The order page is accessed through a unique private link. AI-generated results are inherently variable: they may contain artistic changes, inaccuracies or details that differ from your appearance or expectations. Previews demonstrate a style, not a guaranteed exact result. We will use reasonable care to provide the number of portraits stated at checkout.

3. Your photos and acceptable use

  • You must own your uploaded photo or have the subject’s permission and all rights needed to use it.
  • Do not upload content involving a child, unlawful activity, sexual or exploitative material, harassment, impersonation, infringement or violation of another person’s privacy or publicity rights.
  • Do not probe, disrupt, automate abusive requests to or circumvent security or access controls of the Service.
  • A clear, well-lit, front-facing photo without heavy filters gives the best results. Poor source quality can materially affect output quality.

We may reject an order or remove content that reasonably appears to violate these Terms.

4. Orders, prices and payment

Each order is a one-time purchase with no subscription or automatic renewal. Prices are displayed in US dollars (USD) unless checkout clearly states otherwise. An order is not paid until a payment provider confirms receipt of funds. Payment availability, methods and processing are described in our Payment & refunds policy. We may correct an obvious pricing or technical error before accepting payment.

5. Delivery, storage and support

Portraits are delivered to the private order page and are ordinarily available for 14 calendar days from order creation. You are responsible for downloading them during that period. Generation times are estimates and can be affected by demand, provider availability and technical issues. If the Service does not deliver the purchased output, contact [email protected].

6. Rights in images

You retain your rights in the uploaded photograph. As between you and GirlAndStories, you may use the portraits delivered for your order for personal or commercial purposes, subject to applicable law and any third-party rights. You grant us and our processing providers a limited, worldwide, non-exclusive licence to host, copy, adapt and process the uploaded photo only as needed to provide, secure and support the Service. The licence ends when the relevant files are deleted, except for limited backups or records we must lawfully retain.

7. Cancellations, refunds and mandatory rights

Our Payment & refunds policy forms part of these Terms. Nothing in these Terms excludes a cancellation, refund, conformity, cooling-off or other consumer right that cannot lawfully be waived. Where permitted by law, you request that digital performance begin promptly after payment and acknowledge that applicable cancellation rights may change once performance has begun.

8. Disclaimers and liability

To the maximum extent permitted by applicable law, the Service is provided on an “as available” basis and we do not guarantee uninterrupted operation or that creative results will match subjective preferences. We do not exclude liability that cannot legally be excluded, including liability for fraud, wilful misconduct or death or personal injury caused by negligence where applicable. For other claims, and to the extent lawful, our aggregate liability relating to an order will not exceed the amount you paid for that order.

9. Changes, suspension and disputes

We may update these Terms prospectively by publishing a revised version and effective date. We may suspend access where reasonably necessary for security, maintenance or a suspected violation. If a dispute arises, please contact us first so we can try to resolve it. Applicable law and venue are determined by mandatory consumer protections and conflict-of-law rules; these Terms do not deprive you of protections or courts available to you under the law of your usual residence.
